(hereinafter both called "organiser") with the contracting parties (hereinafter called "client"). In contracts with consumers, the German Law on Remote Sales (Fernabsatzgesetz) takes priority.
Registration and Confirmation of Registration
Registration must be made in writing (by letter or fax) to the organiser's address (see General) or on the Internet at www.repro-gravure-support.de by means of the organiser's registration form.
If the client and the participant are not one and the same person, the client must ensure before each registration or reregistration that the participant is aware of the organiser's terms and conditions and agrees to them. Should the client not meet this obligation, he will be responsible to the organiser for all damages thus caused by the participant.
Registrations will only be processed if the maximum number of participants has not yet been reached. Once written confirmation of registration has been sent, the registration is considered as having been accepted and the contract has been concluded.
Scope of Performance and Participation Fee
For seminars, the participation fee includes: training, instruction material, use of the training aids available, refreshments and a certificate of participation. For all other events, the fee covers only the right to attend the event. All other expenditures and expenses, especially travel costs, hotel expenses and meals have to be paid separately by the client.
Partial attendance of the events does not give the right to a reduction of the participation fee. This is due within 14 days of receipt of the invoice and must be paid in full at the latest on the day before the event begins.
Reregistration and Cancellation
The client may assign his registration free of charge to another participant, at the latest on the last business day before the event begins, insofar as this person qualifies for participation in the event.
The client may cancel his registration with the organiser:
- free of charge up to 14 calendar days before the event begins,
- 13 to 8 calendar days before it begins at a fee of 25 % of the participation fee,
- 7 calendar days until the last business day before the event begins the full participation fee is due, unless another participant can be found as a substitute.
Reregistrations and cancellations must be carried out in writing (letter/fax). The date of delivery is decisive in determining whether the deadline has been met.
Should the client not make use at all or in time of his right of reregistration or cancellation or should the registered participant not come to the event, the client must pay the full participation fee.
Cancellation of Events by the Organiser
The organisers reserve the right to cancel events for organisational reasons, for example if the minimum number of participants has not been reached, or to cancel at short notice because of the sudden absence of the trainer due to illness. Should the organiser cancel the event, he will attempt to book another date and/or another venue for the participant, should the client agree to this. Otherwise, the client will be reimbursed for the fees paid. There are no further claims, particularly claims for damages.
Copyrights and Trademark Rights
All documents and copies handed out are protected by copyright and may not be copied, not even in an abridged form, without previously receiving the organiser's written permission. Any scripts which may be handed out are given to the participants for their sole and exclusive use.
Registered Trademarks
The organiser accepts no responsibility for the products, methods and other names being free of third party copyrights, etc.
Liability
The organiser is only liable for those damages caused wilfully or grossly negligently by himself or his employees. All further liability is excluded. In commercial dealings, liability is limited to those damages which are typically caused within the scope of public events subject to a charge.
All participants are strictly prohibited from using their own data carriers on the organiser's equipment. In case of non-compliance, the organiser reserves the right to assert damages.
Data Protection
Data transferred to the organiser will be saved electronically, taking into consideration the legal regulations for data protection.
Invalidity of Individual Sections of the Contract
Should a provision or section of the contract be invalid, this will not affect the validity of the remaining provisions. As far as possible, invalid provisions will be replaced by provisions which come closest to the economic purpose aimed for.
Applicable Law
The law of the Federal Republic of Germany will be solely applicable for the contractual relationship and its implementation.
